REGULATIONS:

1. General Provisions

  1. The Internet Shop SYSKA.DESIGN is run at the address www.syska.design by Agnieszka Syska in order to sell Goods via the Internet, through the website, and to provide Services provided electronically for this purpose, in accordance with provisions of the Regulations.
  2. The Internet store is a tool through which the Seller conducts sales of Goods via the Internet and is one of the means of concluding an agreement for Goods with the Seller.
  3. The Internet Shop is operated in accordance with the Regulations and provisions of law applicable to the Internet Shop and the Seller's operations on the Internet.
  4. The Regulations define:
    • principles of operation and use of the Online Store, including the principles of concluding agreements via the Online Store, the principles of placing orders for Goods and the principles of processing orders for Goods;
    • the Seller's
    • the rights and obligations of the Seller and the Client relating to the activities referred to in point a) above;
    • the type and scope of the Services
    • type and scope of Services provided electronically;
    • conditions for provision of the Services
    • contingent of conclusion and termination of agreements on provision of Services provided by electronic means;
    • mode of complaint procedure concerning Services provided by electronic means;

2. Definitions and contact information

Terms used in the Regulations with a capital letter shall mean:

  • Internet store - a system of websites made available and operating under the domain address www.syska.design and sub-domains, with the use of which the Seller conducts sales of Goods via the Internet and equipped with IT functionalities allowing to conclude an agreement via it;

  • Customer - every legal entity, i.e. natural person, legal person or organizational unit without legal personality, who has legal capacity and ability to perform legal actions, to the extent allowing for the use of the Online Store and concluding a contract for Goods via the Online Store, and who uses the functionality of the Online Store, in particular purchases Goods via the Online Store;
  • Content - all substantive content of the Internet Shop, including in particular information about the Goods and the Seller;
  • Customer Account - a functionality of the Online Store, consisting of making available the IT functionalities of the Online Store, consisting of defining information individualizing the Customer and allowing the recording of information about actions performed by the Customer; a Customer Account is created for the Customer in the Customer Registration procedure; .
  • Order Form - a functionality of the Online Store, containing the necessary information concerning the Client and the order for Goods placed by it, which are sent to the Seller via the Online Store as part of the procedure for conclusion of the agreement for the Goods and used for placing by the Client of an order for the Goods with the use of the Online Store; .
  • Customer registration - a procedure constituting a functionality of the Online Store, used for creation of a Customer Account, and thus conclusion of a contract for electronic provision of services in the form of a Customer Account, during which the Client fills in the registration form, providing a login and password, which he or she will use to log in to the Online Store, providing data, including personal data indicated in the registration form, and making relevant statements. The Client's registration is completed at the moment of activating the link sent to the e-mail address given in the registration form; .
  • Consumer - a natural person who makes a legal transaction with the Entrepreneur, i.e. the Seller, which is not directly related to his/her business or professional activity;
  • Goods - all movables sold by the Seller with the use of the Internet Shop; .
  • Regulations - these regulations governing the functioning of the Internet Shop, placed on the website of the Internet Shop; .
  • Telecommunication System - a set of cooperating IT devices and software, ensuring the processing and storage, as well as sending and receiving data via telecommunication networks by means of a telecommunication end device appropriate for a given type of network, within the meaning of the Act of 16 July 2004. - Telecommunications Law (Journal of Laws No. 171, item 1800, as amended); .
  • Electronic communication means - technical solutions, including data communication devices and software tools cooperating with them, enabling individual long-distance communication by means of data transmission between data communication systems, in particular electronic mail; .
  • Service provided electronically - a service consisting of making available appropriate functionalities of the Internet Shop, constituting the provision of services by electronic means within the meaning of the Act on Provision of Services by Electronic Means, i.e. the performance of a service provided without the simultaneous presence of the parties (at a distance), through the transmission of data at the individual request of the recipient of the service, sent and received by means of equipment for electronic processing, including digital compression, and data storage, which is entirely transmitted, received or broadcast via a telecommunications network within the meaning of the Act of 16 July 2004. - Telecommunications Law; Regulations specify the types and scope of Services provided electronically by the Seller; .
  • Payment Service Provider - an entity providing payment services within the meaning of the Payment Services Act of 19 August 2011 (Journal of Laws 2014.873 j.t.) enabling the Customer to pay for the Goods via bank transfers, online transfers, payment cards, credit cards or debit cards or any other method used for sales via the Internet and made available in the Online Store, in particular Przelewy24. .
  • Translewy24 - PayPro SA, ul. Kanclerska 15, 60-327 Poznań, entered in the register of national payment institutions kept by the Polish Financial Supervision Authority under the entity number in UKNF IP24/2014, operating an online service, intermediating in the transfer of payments .
  • The Act on Provision of Services by Electronic Means - the Act of 18 July 2002 on Provision of Services by Electronic Means (Dz.U.2013.1422 j.t. as amended);
  • Consumer Rights Act - the Act of 30 May 2014 on consumer rights (Journal of Laws 2014.827 as amended);

3. Procedure of concluding an agreement in the Internet Shop

  1. The Internet Shop is used to conclude contracts of sale of Goods between the Client and the Seller.
  2. Notwithstanding the above, the Seller shall be entitled to conclude contracts of sale of Goods.
  3. Notwithstanding the provisions of paragraph 1, as part of the use of the Online Store, agreements are concluded between the Clients and the Seller on services rendered electronically, as described in the Regulations
  4. The procedure for concluding an agreement for Goods via the Online Store consists of the technical steps described in section 5 related to submitting an order by the Customer and the technical steps described in section 7 related to confirmation of the order. The procedure for conclusion of agreements for electronically supplied services is regulated in § 7 of the Regulations.
  5. In order for the Customer to fully use the Online Store, i.e. make use of all its available functionalities, it is necessary:
  6. To creation on the Online Shop website by the Customer of a Customer Account through Customer Registration;
  7. Signing in to the Online Shop
  8. logging into the Customer Account using the login and password;
  9. In order to properly place an order by the Customer, the following actions are necessary:
  10. using the Order Form with the Customer Account (after logging in) or without having or using the Customer Account;
    • select the ordered Goods; .
    • select one of the available payment methods
    • select one of the available delivery methods; .
    • confirmation of the order in accordance with the choice made, which results in the obligation to pay;
  11. If the order is correctly placed by the Customer, the order is immediately sent to the Seller through the Online Store.
  12. After receiving the Customer's order in accordance with Clause 6, the Seller shall immediately send a message to the Customer's e-mail address given in the Customer Account or Order Form confirming the placement of the order placed by the Customer.
  13. Instant confirmation by the addressee of the offer receipt results in binding the content of the submitted offer.
  14. The data necessary to conclude a contract in the Online Store as part of the contract conclusion procedure are entered, recorded and available through the Customer Account and the Order Form. The confirmation of order placement referred to in section 7 shall include data constituting the content of the concluded agreement.
  15. Using the Online Store and its functionality, including in particular entering information in the Customer Account, Order Form or Application Form, as well as detecting errors in this information and correcting them, shall be performed with the use of an appropriate application - Internet browser (e.g. Internet Explorer, Mozilla Firefox, Google Chrome, Opera, etc.).
  16. Communication with the Customer in connection with the conclusion of a contract via the Internet Store takes place over the Internet using the data communications system and means of electronic communication;

4. Payments

  1. Payments of Customers for Goods purchased in the Online Store take place through:
    • traditional bank transfer or money order;
    • paying by bank transfer or money order
    • payment methods made available in the Online Store, supported by the Payment Service Provider, in particular Przelewy24 and PayPal, i.e. online transfer, payment card payments, including credit card payments, mobile payments, electronic wallets or other payment forms offered for payment for transactions in the Internet, if they have been made available in the Online Store.
  2. The prices of Goods specified in the Online Store are prices expressed in Polish zloty, including the amount of tax on goods and services. Prices do not include the cost of delivery.
  3. The total cost to be paid for a given order from purchases made in the Online Store shall be the sum of the price of the ordered Goods, costs of delivery of the Goods (selected method of delivery), costs of the selected method of payment (if applicable). All payments making up the total cost to be paid shall be specified in the Online Store, in particular in the ordering procedure for the Goods.
  4. The price quoted next to each Goods is binding at the time the Customer places the order.
  5. Payments referred to in section 1 shall be made in accordance with the following rules:
    • the payments are handled by the Payment Service Provider;
    • the payments can be made by the Customer at the moment of ordering.
    • payments may be made only by persons authorised to use a given payment method;

  6. payments shall be made in accordance with the rules applied by a given Payment Service Provider, made available by the Payment Service Provider; .

5. Deliverables

  1. The goods ordered from the Online Store are issued (shipped) via a specialized courier company. .
  2. Orders for Goods are fulfilled within 10 working days from receipt of payment for the order, which means that within this period the ordered Goods are delivered for shipment according to the chosen method of delivery of the Goods, subject to passage 3 .
  3. If the given Goods are marked as unavailable in the Online Store, the fulfillment of the order, according to passage 2 is possible after the Goods availability is restored on the date indicated in the Online Store .

6. Customers' obligations

  1. All information provided by the Customer in the Online Store, including the Order Form, the Application Form and the Customer's Account, in particular information provided for the purpose of concluding an agreement in the Online Store, should be consistent with the actual state of affairs.

7. Service provided electronically

  1. The Seller via the Online Store provides services electronically. Services provided electronically are free of charge.
  2. Services provided electronically, as referred to in paragraph 1 consist in making available to the Client all functionalities of the Online Store, including those enabling the conclusion of an agreement with the Seller via the Online Store concerning the Goods, and in particular consist in:
    • disclosing, at the individual request of the Client, information placed within the scope of the Internet Shop by displaying a page with a specified URL, including information concerning the Seller and the Goods, as well as information concerning the manner of concluding the agreement and its performance;
    • allowing, at the individual request of the Client, the Seller to make available the information concerning the Goods, as well as information concerning the manner of concluding the agreement and its performance
    • enabling, at the individual request of the Client, communication in order to conclude a contract, including placing an order, in particular through an Order Form
    • enable the Client to conclude a contract for Goods via the Online Store, including enabling to agree the terms of the contract, determine the price and shipping costs;
    • presentation of the Goods sold via the Internet Shop and their search;
    • enable other contact with the Seller
  3. By means of the Internet Shop, the Seller provides in particular the following services provided electronically: 
  • Customer Account and Order Form .
  • provision of Content, including a withdrawal form and a complaint form;
  • contact services
  • contact services, including newsletter and contact form;

To conclude an agreement for a Customer Account occurs through the establishment of a Customer Account under the Customer Registration procedure. To conclude an agreement for other services provided electronically comes through the initiation by the Customer of the use of a particular service provided electronically, i.e. by proceeding to use the given functionality of the Online Store. The use of Services provided electronically by the Customer takes place according to the rules indicated in the Regulations. The Customer may terminate the use of a given Service provided electronically at any time. The termination of the agreement on the use of a given electronically supplied Service is made by ceasing to use the given functionality of the Internet Shop. In this case, the agreement on the use of services provided electronically is automatically terminated without the need for additional statements from the parties, subject to paragraph 6. Termination of the agreement for a Customer Account is made by using the option to delete the Customer Account. In order to properly use the Services provided electronically, the Customer should have:

  • connection to the Internet;
  • computer equipment
  • computer equipment and software with the functionality of a web browser that allows you to display HTML documents on the computer screen or a mobile device that allows, with the appropriate software, to use the application with the function of a web browser for mobile devices.

Accordingly, Article § 9 paragraphs 3-5 of the Regulations shall apply to complaints regarding services provided electronically.

8. Withdrawal from the Agreement

  1. According to Article 27 of the Act on Consumer Rights, the Customer who is a Consumer, who has entered into an agreement through the Online Shop, has the right to withdraw from the agreement:
    1. containing
    2. concerning Goods;
    3. - concerning Services
    4. concerning electronically supplied services; .
  2. An explanation of the principles of exercising the right of withdrawal and its consequences is attached to the Terms and Conditions together with the withdrawal form.
  3. The right of withdrawal from an agreement concluded off-premises or at a distance is not granted to the Consumer with respect to agreements:
    1. for
    2. delivery of digital content which is not recorded on a tangible medium, if performance has begun with the Consumer's express consent before the end of the period for withdrawal and after the trader has informed the Consumer of the loss of the right to withdraw from the contract;
    3. where performance has begun with the Consumer's express consent before the end of the period for withdrawal and after the trader has informed the Consumer of the loss of the right to withdraw from the contract
    4. where the object of performance is a thing (Goods) not prefabricated, produced to consumer specifications or used to meet his individual needs;
  4. Consumer withdrawing from the contract shall be liable for diminished value of the thing (Goods) resulting from the use of it in a manner beyond the necessary to ascertain the nature, characteristics and functioning of the thing (Goods).

9. Complaints

  1. The Seller shall be obliged to deliver items (Goods) without defects.
  2. The Customer shall be entitled to rights under the warranty referred to in the provisions of the Civil Code, subject to paragraph 7.
  3. The possibility of return does not apply to products made to individual customer order and made in variants other than the standard e.g. colors, size.
  4. Claims should be submitted using the contact details of the Seller referred to in § 2 paragraph 2 of the Terms and Conditions.
  5. In order to facilitate the processing of a complaint, it is suggested that you provide the following information: name and surname, exact address (street, postal code, city), contact telephone, email address, description of the order, reason for complaint.
  6. The complaint procedure referred to in paragraphs 3-4 of these Terms and Conditions is a suggested procedure and in no way excludes or limits the legally permissible ways of filing claims.
  7. Claims are handled in accordance with the rules resulting from warranty, referred to in the provisions of the Civil Code, subject to passage 7. The Client, who exercises rights under warranty, is obliged to deliver defective Goods at the expense of the Seller to the address of the Seller, referred to in § 2, passage 2 of the Regulations. This also applies to return of the Goods in the case of withdrawal from the agreement and replacement of the Goods with defect-free ones.
  8. For Clients who are not consumers, the Seller's liability under warranty is excluded pursuant to Article. 558. § 1 of the Civil Code.

10. technical requirements

  1. The Internet Store can be accessed and used on operating system platforms that allow the use of the Internet and software with Internet browser functionality allowing HTML documents to be displayed on a computer screen, on any type of computer that meets the requirements of such operating systems and through any type of Internet connection using software with Internet browser functionality, such as Microsoft Internet Explorer, Mozilla FireFox, Opera and Google Chrome 23.X (only version for MS Windows) or on mobile devices equipped with software enabling the display of the Online Store on such devices, in particular applications with web browser functionality for mobile devices.

11. Final provisions

  1. The Internet Shop and actions related to concluding agreements in the Internet Shop are available in the Polish language.
  2. The Regulations are made available to the Client on the Online Store website prior to the conclusion of an agreement, and also - at the Client's request - in a form, which makes it possible to obtain, reproduce and record the contents of the Regulations by means of a data communications system, which the Client uses, including in particular downloading, copying, downloading and saving them to the Client's hard drive, or printing.
  3. The Regulations are also available in the form, which makes it possible to obtain, reproduce and record the contents of the Regulations by means of a data communications system, which the Client uses, including in particular downloading, copying, downloading and saving them to the Client's drive, or printing them.
  4. Regulations are an integral part of the agreement concluded through the Online Store, including the agreement for Services provided electronically.
  5. The Client has the right to lodge a complaint referred to in these Terms and Conditions, as well as to exercise other claims arising from the provisions of law.

  7. The Regulations may be amended. The amended Regulations shall be made available pursuant to section 2 and shall apply to orders for Goods placed after they are made available, in particular, the amendment of the Regulations shall not apply to orders placed before they are made available, as well as to Services provided electronically, which the Customer started using before they were made available. With regard to services of a continuous nature, i.e. the Customer Account service, if the Regulations are amended during the term of this service, the amendments to the Regulations shall be binding on the Customer if he or she does not terminate the agreement for a Customer Account by deleting the Customer Account within 14 days of making the amendment to the Regulations available.
  8. To the extent not covered by these Regulations, generally applicable provisions of law shall apply, in particular the Civil Code, the Act on Consumer Rights, the Act on Electronic Provision of Services.
  9. The competent court for any disputes arising from the sales contract is the court with jurisdiction over the defendant's registered office or the competent court for the place of performance of the contract.
  10. Personal data given on the order form in the syska.design online store are collected and processed in accordance with the Act of 29 August 1997 on the Protection of Personal Data (Journal of Laws of 2002, No. 101, item. 926, as amended). Gathered personal data is used only and exclusively for the purpose of processing placed orders and informing about promotions and under no circumstances will it be made available to third parties. Each customer of our store has the right to inspect, modify and delete their personal data from our database.
